Our Services
Description
Our apps provide a variety of sound-based experiences designed to improve sleep, focus, and relaxation. Features include sound playback, user-generated sound effects, a mix of multiple sounds, utility tools, and optional premium accounts.
User Accounts
To access features of Tingles ASMR and Encyclopedia: STEM for Kids, you are required to create an account using Google or Apple authentication. You are responsible for maintaining the security of your authentication credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Premium Accounts and Payments
Our apps offer premium services that are available through in-app purchases. All payments are processed through third-party services. By making a purchase, you agree to their terms and conditions.
Copyright Concerns
If you believe that any content available on our apps infringes upon your copyright, you may request its removal by contacting us at info@initiatehub.com. We will promptly review and respond to your request.
User-Generated Content
You may upload or record sound effects using our apps. By uploading content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content through our apps.
Data and Privacy
We take your privacy seriously. Our use of your data is outlined in our Privacy Policy.
Restrictions
You agree not to use our apps in any manner that is illegal or harmful. You are also not permitted to exploit any part of our service for commercial purposes without our express consent.
Termination
We reserve the right to terminate or suspend your account and access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to us, other users, third parties, or for any other reason.
Refund Policy
All purchases and subscriptions are processed through Apple App Store or Google Play Store. Refund requests must be made directly through the respective platform according to their refund policies. We do not have direct control over refunds, as all transactions are managed by Apple and Google.
Disclaimer of Warranties
Our apps are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our apps will be uninterrupted, secure, or error-free. You use our apps at your own risk.
Limitation of Liability
To the maximum extent permitted by law, initiateHUB, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use our apps
- Any unauthorized access to or use of our servers and/or any personal information stored therein
- Any interruption or cessation of transmission to or from our apps
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our apps by any third party
- Any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through our apps
In no event shall initiateHUB's total liability to you for all damages, losses, and causes of action exceed the amount you have paid to us in the last twelve (12) months, or one hundred dollars ($100), whichever is greater.
Indemnification
You agree to defend, indemnify, and hold harmless initiateHUB, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with:
- Your access to or use of our apps
- Your violation of these Terms
- Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right
- Any claim that your content caused damage to a third party
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of our apps shall be subject to the exclusive jurisdiction of the courts of Ireland.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
